Service-Specific Terms
These terms supplement our General Terms of Service and apply specifically to cloud storage and file synchronization services. Where conflicts arise, these service-specific terms take precedence.
OpenDucks IT provides cloud storage services including file hosting, synchronization, sharing, collaboration features and related infrastructure. Services may be delivered through Nextcloud installations, custom file management solutions, or other platforms as specified in your service agreement.
Available features include:
Your data is hosted in data centers located in Germany, the Netherlands, or France, depending on availability and your selected configuration. We will inform you of the primary data location for your service.
You acknowledge that data may be processed in the specified region(s) and that we operate under EU data protection laws, including GDPR.
Server-side encryption: Data stored on our systems is encrypted at rest using industry-standard encryption methods.
End-to-end encryption (optional): When enabled, end-to-end encryption ensures that files are encrypted on your devices before upload and can only be decrypted on your devices using your encryption keys. We cannot access encrypted content when end-to-end encryption is active.
You are responsible for securely storing your encryption keys. Loss of encryption keys may result in permanent data loss.

Your service includes the storage capacity specified in your service agreement. Usage beyond allocated limits may result in:
We reserve the right to set reasonable file size limits and implement rate limiting to ensure service stability.
You may share files and folders with external users through secure links or guest accounts. You are responsible for:
We may disable external sharing features if abuse is detected or upon your request.
We maintain regular backups of data stored on our systems according to the backup schedule specified in your service agreement. Backup frequency and retention periods vary by service tier.
You are responsible for maintaining local backups of critical data. We recommend testing restore procedures periodically.
Data recovery requests must be submitted through our helpdesk and may be subject to additional fees depending on scope.
Target availability for cloud storage services is 99.5% monthly, excluding scheduled maintenance and force majeure events. Scheduled maintenance will be announced in advance when possible.

Upon service termination, you will have a period of 30 days to export your data. After this period, data may be permanently deleted unless legal obligations require retention.
Deleted data cannot be recovered after the retention period. We recommend maintaining local backups of important files.
Our liability for cloud storage services is subject to the limitations outlined in our General Terms of Service. We are not liable for:

User training, custom application development, and data recovery beyond standard procedures may be subject to additional fees.
We may modify these terms with 30 days' notice. Continued use of the service after modifications takes effect constitutes acceptance of the new terms. Material changes will be communicated via email or service notifications.
